Growth Energy Files Intent To Sue The EPA Over RVO Inaction

This week, Growth Energy submitted a notice of intent to sue the Environmental Protection Agency. Growth Energy’s Senior Vice President of Regulatory Affairs Chris Bliley says their notice is in response to the agency’s failure to fulfill its statutory obligation to issue the 2021 renewable volume obligations under the Renewable Fuel Standard.

He says the uncertainty created by not getting those RVOs out by the November 30 2020 deadline has added to the damage caused to biofuels producers this year.

Bliley says announcing this intention to seek litigation is their only recourse in protecting their industry going forward.

Bliley says the notice they gave to the EPA gives the agency 60 days to issue the 2021 RVO before risking a lawsuit in federal court.
