A coalition of seven agriculture and biofuel groups, including the American Coalition for Ethanol, have petitioned the Environmental Protection Agency to change its method for granting RFS waivers. ACE CEO Brian Jennings says the EPA needs to change its regulations to account for lost volumes of renewable fuels resulting from the large numbers of waivers approved.
He says if the EPA responds to their petition and changes their waiver granting method, then the groups will withdraw their lawsuit against the agency.
Jennings says they’ve tried to get better oversight over the EPA decision making on the waivers from Congress but have run into a snag in an important Senate committee.
Jennings says their coalition has asked the Court of Appeals for the District of Columbia Circuit to stay the proceedings on their lawsuit for a period time until they hear back from the EPA on their just issued petition.
