This week, the U.S. Supreme Court said the EPA cannot write specific standards for power plant and factory emissions of greenhouse gases. The Court also upheld EPA’s authority to regulate sources responsible for 83 percent of greenhouse gas emissions. South Dakota Farm Bureau President Scott Vanderwal says his group’s legal team is reviewing the decision but sees it as a win for agriculture.
Vanderwal says if EPA’s proposed emissions rule on power plants is approved it will be costly for everyone, ag and non ag interests alike.
Supreme Court Justice Antonin Scalia said EPA sought to regulate sources it said was responsible for 86 percent of all greenhouse gases emitted from stationary sources nationwide. Under the Court decision, EPA will be allowed to regulate sources responsible for 83 percent of those emissions.
