Farm groups want Supreme Court to Define TMDL Jurisdiction

Farm groups including the American Farm Bureau want the U.S. Supreme Court to define whether states or the federal government have the authority to rule on whether total maximum daily loads are a violation of state’s rights. T-M-D-L s are aimed at reducing the flow of nutrients into bodies of water.
Nebraska Farm Bureau National Affairs Coordinator Jordan Dux says they want the High Court to keep the EPA from expanding its regulatory authority.

Dux says it doesn’t make sense to have the EPA micromanage what state regulatory agencies are already doing. And he says they know the water issues better in their own areas.

Joining Farm Bureau in the legal challenge are the National Pork Producers Council, The Fertilizer Institute, National Chicken Council, National Turkey Federation and National Corn Growers Association.
