Several farm groups including the National Milk Producers Federation and National Pork Producers Council have written EPA and the Corps asking them to nationally delay implementation of the Waters of the U.S. rule. Federation’s Chris Galen says the rule is set to be implemented in 37 states not covered by an injunction, which leaves uncertainty.
He says with one court injunction granted and two thrown out, it just adds to the confusion producers are already facing with the rule.
Galen says the EPA needs to rethink their WOTUS policy and come up with an alternative plan.
EPA officials say they are studying the court decisions and considering next steps in the litigation.
