A November 15 deadline is looming for mandatory reporting of air emissions from agricultural operations. A federal court ruling prompted by an environmental activist lawsuit requires the reporting under CERCLA or the Comprehensive Environmental Response, Compensation and Liability Act. Minnesota Pork Producers Association President Jay Moore says the National Pork Producers Council has asked for a delay in that reporting because farmers need more specific and final guidance to enable them to comply with the ruling.
He says pork producers are at a disadvantage with this reporting requirement due to its vagueness.
Moore also says the reporting regulation may cause emergency responders to think there’s a major release when all producers are doing is applying manure.
Both the NPPC and U.S. Poultry and Egg Association have filed a brief in support of the EPA’s motion to the court asking for a delay in the mandated reporting rule.
