The EPA will not appeal a federal ruling that favored a West Virginia poultry producer regarding farm run off. EPA had sought to regulate ordinary storm water runoff from the poultry farm however a court ruled against the agency. Nebraska Farm Bureau National Affairs Coordinator Jordan Dux says EPA was clearly in the wrong and the ruling and drop of the appeal is a big win for agriculture.
Dux is hoping this ruling will spill over into stopping EPA’s overreach with their proposed Waters of the U.S. Rule which also involves the Clean Water Act.
EPA officials says their withdrawal from the West Virginia case does not change either the law or their commitment to protecting water quality.
