A coalition made up of the Renewable Fuels Association, the American Coalition for Ethanol, the National Farmers Union and National Corn Growers are welcoming reports that President Trump has directed the EPA to deny the gap year small refiner waiver petitions. RFA President and CEO Geoff Cooper says they’ve been asking for that rejection for some time and are encouraged to hear this latest report.
He says they’re in the process of weighing in with the Administration and the Environmental Protection Agency to confirm the gap waivers are going to be denied.
Cooper says CVR Refining and Holly Frontier Corporation are asking the U.S. Supreme Court to review the 10th Circuit Court Decision that overturned three small refiner waivers. He doesn’t think they have much of a chance of not only getting that reviewed or the lower court ruling overturned.
The gap waivers in question involve 67 petitions for retroactive waivers, some dating back as far as 2011.
