A coalition of ethanol and farm groups led by the American Coalition for Ethanol have sent a letter to EPA opposing a petition requesting reconsideration of the 2020 Renewable Fuel Standard final rule. American Coalition for Ethanol CEO Brian Jennings says the petition was brought forward by the American Petroleum Institute challenging a court ruling that stopped the issuance of small refinery waivers.
He says the API is concerned that the EPA will follow the tenth circuit court decision that threw out the RFS waivers granted earlier by the agency.
Jennings says their coalition wants to make sure the EPA follows the RFS and the final rule it put in in 2020. He also says that even if they do that and follow the tenth circuit court ruling, it still won’t make up for lost volumes of ethanol that should have been blended.
In their letter the ethanol and farm group coalition said the 2020 RFS volumes should not be adjusted downward to remove reallocated volumes even after EPA applies the Tenth Circuit Court decision nationally.
