EPA’s 2015 WOTUS Struck Down in Courts

A Federal Court in Georgia has sent the 2015 WOTUS rule back to the EPA and left a preliminary injunction in place in 11 states. National Cattlemen’s Beef Association’s Chief Environmental Counsel Scott Yager says the U.S. District Court found the EPA overstepped the Clean Water Act and violated the Administrative Procedures Act in drafting the rule.

He says the court decision should help the Trump administration get the Obama Era regulation totally repealed.

Yager says it’s possible the repeal could happen in a few weeks, with the rewritten measure put in place by the end of 2019.

The Georgia Court found the EPA misread Supreme Court precedent and encroached on the traditional powers of the states to regulate their waters.
