EPA Wants to Delay 2015 WOTUS Rule Two Years

The Environmental Protection Agency wants to prevent the 2015 Waters of the U.S. rule from going into effect while they rewrite the regulation. Nebraska Cattlemen Association Director of Legal and Regulatory Affairs Jessie Herrmann says the agency has proposed to extend the effective date of the rule by two years.

EPA is preparing a notice for the Federal Register that will trigger a 21-day public comment period. She says her group has filed comments on what they want in the rewritten regulation.

Herrmann says the delay will give the agency time to continue stakeholder meetings across the country ahead of the rewrite and avoid confusion.

In the meantime, the agencies have embarked on a temporary proposed rule to revert back to the WOTUS rule prior to 2015.
