EPA to Release New Waters of the U.S. Rule

The Environmental Protection Agency is scheduled to release the new Waters of the U.S. rule this week. WOTUS is one of the main concerns for Nebraska Cattlemen members who just wrapped up their state convention. President Mike Drinnen says they’re awaiting details and are anxious to see the 2015 rule replaced, which had several problems.

He says whatever the EPA comes up with in a new WOTUS regulation, it needs to be transparent and simple to understand.

Drinnen says one of EPA’s proposals for the new WOTUS would remove some areas from Clean Water Act jurisdiction.

In its review, the EPA will consider the term navigable waters as defined in the Clean Water Act in a manner consistent with the opinion of Justice Antonin Scalia. That opinion calls for stakeholders and the public to have certainty as to how the CWA applies to their activities.
