EPA Has November Deadline to Decide on CERCLA Requirements

The Environmental Protection Agency has until November 14 to decide how to enforce emissions requirements on animal feeding operations across the country. Those operations are required to report under CERCLA or the Comprehensive Environmental Response, Compensation and Liability Act. Iowa Pork Producers Association CEO Pat McGonegle says having until November to report gives producers time to figure out how to come into compliance.

He says producers are used to reporting to government agencies but need some more clarity with the CERCLA rules.

McGonegle encourages all pork producers to stay in touch with their local and state pork groups to keep on top of this issue.

The CERCLA rule issued in 2008 gave a blanket exemption to ag operations however a DC Court of Appeals decision recently issued says the EPA illegally exempted all but the largest operations from reporting. Now all operations must report.
