Environmental Groups Challenge Repeal of 2015 WOTUS

Environmental groups challenging the Environmental Protection Agency’s repeal of the 2015 Waters of the U.S. Rule have asked a federal court to stay the case. National Cattlemen’s Beef Association’s Chief Environmental Counsel Scott Yager isn’t surprised by the move and anticipated that would happen.

He says if the court rules against the repeal and puts the 2015 WOTUS rule in effect, that would be devastating for the U.S. cattle industry. Yager also thinks this request for a court stay is just the first volley in the battle over WOTUS in the courts.

Yager thinks the Trump Administration did a good job in describing why they repealed the 2015 WOTUS and that that repeal will be upheld.

Yager thinks eventually the battle over the WOTUS repeal will be heard by the U.S. Supreme Court.
