Egg Industry Continuing To Challenge California Law

The United States Supreme Court has decided not to hear oral arguments in a case where 15 states are challenging California’s law that the states are charging violates the Commerce Clause of the U.S. Constitution. National Association of Egg Farmers President Ken Klippen says even though they didn’t get a hearing before the high court they’re not giving up on their fight.

California’s law which came about after the passage of two ballot measures says that they’ll only allow eggs produced from cage free hens. Klippen says only Congress is authorized to regulate commerce.

Iowa Poultry and Egg Association Executive Director Kevin Stiles agrees with Klippen that the fight is not over. He says they’re studying how the California regulation effects their egg producers.

Three of the Fifteen states challenging the California law include: Iowa, Nebraska and North Dakota.
