A constitutional law professor doesn’t believe the courts will allow a change to the Nebraska Republican gubernatorial ticket to stand.
Creighton law professor Mike Fenner says it appears to him there was no basis in law for Secretary of State John Gale to allow Republican gubernatorial candidate Pete Ricketts to replace Lavon Heidemann as his running mate with Mike Foley. . .


A Lancaster County judge is considering a lawsuit filed by the Libertarian candidate for governor. The issue might ultimately be decided by the state Supreme Court.

Fenner says a quick decision is needed.


The Secretary of State allowed Ricketts to change the name on the ballot, reasoning that Ricketts’ constitutional right to name his running mate trumped the deadline set out in state law.
