A federal court has ruled the Environmental Protection Agency erred when it waived certain biofuel blending requirements set in the Renewable Fuel Standard. The level the EPA set was below the goal set by Congress. The EPA said it waived the requirement because demand pressures limited the ability to increase RFS requirements. The Court ruled the EPA wasn’t allowed to make that determination. POET’s Matt Merritt says it’s a big win for motorists and the biofuels industry.
He says the court’s decision gives the biofuels industry certainty going forward.
Merritt says the court ruling will allow higher blends of ethanol to be used by the nation’s consumers.
Merritt says their hope is that the court decision will lead to the passage of legislation to allow the year round use of E 15 blends.
