This week an Iowa District Court Judge ruled that landowners challenging the Dakota Access Pipeline must take their case back to the Iowa State Utilities Board. Des Moines Attorney Bill Hanigan is representing several landowners who wanted the construction of the pipeline stopped on their property until eminent domain concerns are handled.
Hanigan says if the Iowa Utilities Board doesn’t approve their request then they’ll go back to district court. He says if the District Court doesn’t then rule in their favor, they’ll appeal to the Iowa State Supreme Court.
Hanigan says the landowners who have 15 parcels of land are attempting to get Energy Transfer Partners of Texas, builders of the pipeline to be prevented from digging trenches on their property until eminent domain concerns are satisfied.
