The U.S. Court of Appeals for the District of Columbia Circuit Court this week directed the Environmental Protection Agency to submit a status report every 60 days on its progress in complying with their 2017 court order. That ruling required the EPA to address its improper waiver of 500 million gallons of renewable fuel blending requirements under the RFS. American Coalition for Ethanol CEO Brian Jennings says this ruling is a partial victory for biofuel groups.
He says while the Court ordered the progress report to be done by EPA, it did not rule that the 500 million gallons be restored.
Jennings says the RFS needs some correcting so it’s followed properly.
The Biofuels Coalition challenging the EPA on this issue includes the American Coalition for Ethanol, the Renewable Fuels Association, Growth Energy, the National Biodiesel Board, National Corn Growers Association, National Farmers Union and National Sorghum Producers.
