Congressman Smith Hopes SCOTUS Will Overturn Waters of the United States Rule

Nebraska Congressman Adrian Smith is optimistic the Supreme Court might someday overturn the EPA’s Waters of the United States rule.

Agricultural and business interests have fought the rule, claiming it interprets the Clean Water Act too broadly, extending it to property Congress never intended to be included.

Smith says the Obama Administration’s refusal to compromise on the rule has led to litigation

The Supreme Court has ruled those objecting to an EPA wetlands designation on their property can take the EPA to court.

Smith notes the court only gave property owners threatened by the EPA the right to take federal regulators to court

Separate legal action takes direct aim at the rule, seeking to overturn it.
