Nebraska is taking another route in its legal action against Colorado for legalizing marijuana.
The state claims legalization is contrary to federal law and has caused numerous problems for Nebraska law enforcement.
The Supreme Court declined to take the case directly. Nebraska, joined by Oklahoma, has been allowed to file briefs in a separate lawsuit now before the 10th Circuit Court of Appeals in Denver.
Attorney General Doug Peterson says he still wants to get the case before the Supreme Court.

Peterson says he isn’t worried that other legal challenges in lower courts have proven unsuccessful

While the 10th Circuit has allowed the states to submit briefs, it has yet to decide whether the states can formally join the lawsuit.
