Chicken Operation Facing Lawsuit

Opponents of Sonstegard Foods have filed a lawsuit against the company, Turner County, Pete Sonstegard, and the Turner County Board of Commissioners over the proposed six million chicken operation near Parker. Landowner’s Attorney Michael Schaffer of Sioux Falls says a change to the county zoning ordinance was improperly approved.

Schaffer says based on a fax sent by Pete Sonstegard to the Turner County Commission, the Board approved an ordinance that changed the amount of chickens figured into animal units which effected the setback rules.

Schaffer says they’re basing their court challenge on five factors including due process of the citizen’s being violated.

Schaffer says his client’s problems with the chicken operation include environmental concerns, odor, flies and detrimental effect on the value of their property.
