Turner County South Dakota landowners who challenged the county’s zoning ordinance approving a large chicken farm have won a court decision. Sioux Falls based Sonstegard farms wants to build a 6 million egg laying facility near the Parker City limits. Landowners Attorney Mike Schaffer says the Judge’s decision confirmed what they alleged in their complaint that they weren’t given due process.
Schaffer says part of the problem is that the proposed chicken farm is within 2 and a half miles of Parker and three miles within Marion. He says the prior county zoning ordinance required a much further set back.
He says unless the County appeals the Judge’s decision the issue has to go back to the planning and zoning board.
Schaffer says the Judge’s decision was a well reasoned opinion and went above and beyond what was presented to him.
