The 7 member Biofuels Coalition including the National Biodiesel Board has filed its reply brief in the U.S. Court of Appeals for the D.C. Circuit. NBB’s Paul Winters says that’s in response to a brief from Petroleum groups who don’t want restoration of lost RFS gallons. He says EPA never followed the 10th Circuit Court ruling and has set aside the rule mandated by Congress.
He says the EPA needs to move rapidly to restore lost biofuel gallons.
Winters says the EPA needs to quit dragging its feet and proceed with what the lower court ordered and what Congress established.
At issue is EPA’s failure to address its improper waiver of 500 million gallons of biofuel demand in the 2016 renewable volume obligation.
