Biofuels Coalition Challenges EPA’s Allowance Of Small Refiner Waivers

The Biofuels Coalition consisting of half a dozen renewable fuels groups have filed a legal brief challenging the EPA’s 2019 granting of 31 small refinery waivers from 2018. National Biodiesel Board’s Paul Winters says this is a more lengthy challenge to what was already filed earlier this year.

He says their argument remains that the EPA lacked the authority to issue such exemptions and acted in an arbitrary and capricious manner in allowing those., which was held up earlier this year by the 10th. Circuit Court.

Winters says in their court challenge they’re asking for specific enforcement to make sure the 31 waivers are disallowed.

Joining the National Biodiesel Board in the court action is the Renewable Fuels Association, Growth Energy, the National Corn Grower’s Association, the American Coalition for Ethanol, and the National Farmers Union.
