Biofuel And Ag Groups Ask For Court Rehearing On E-15 Use

Biofuel and Agriculture groups want the D.C. Circuit Court of Appeals to rehear a case involving year-round use of E-15. Renewable Fuels Association President and CEO Geoff Cooper says in 2019, the EPA passed a rule allowing year-round use of E-15 but this past July a circuit court disallowed it. He says they’re requesting a re-hearing from all 11 judges in the Circuit through what’s known as an EN BANC hearing.

He says the original decision ignored some significance evidence that shows E-15 should be offered all year.

Cooper says being able to sell E-15 all year long benefits the biofuels industry, farmers, the environment and consumers.

Cooper says his group, RFA, Growth Energy and the National Corn Grower’s Association all says the original DC Court’s ruling conflicts with the intent of Congress to expand ethanol use.
