South Dakota Attorney General Marty Jackley joined fellow attorneys general from 10 other states in filing comments opposing EPA’s proposed Waters of the U.S. rule. He says the EPA and US Army Corps of Engineers are attempting to expand their federal authority beyond what Congress intended.
Jackley says he and his Attorney General colleagues believe the U.S. Supreme Court has already correctly interpreted the Clean Water Act and how it should be regulated and EPA and the Corps have no business in changing the law to fit their regulatory wishes.
Jackley says EPA’s proposed rule isn’t workable or practical in South Dakota. He adds several South Dakota ag groups voiced concerns over the proposal to his office and to the state department of natural resources.
