The attorney representing the Nebraska Beef Producers Committee says they’re seeking a preliminary injunction in their civil case against the Nebraska Brand Committee and Executive Director William Bunce. Attorney Katy Spohn says their civil complaint asks a federal district judge to declare the Nebraska Livestock Brand Act unconstitutional and to prevent the state from enforcing it.
She says the feedlot operators are bearing a large expense they pay to the Brand Committee and get little or no benefit from it.
Spohn says their strongest argument centers around the Interstate Commerce Act.
The civil case was filed in District Court last week and Spohn says they hope to receive a response to their injunction request sometime this week.
