ASA Supporting En Banc Request And Rehearing For Dicamba

Corteva Agriscience and BASF are asking the Ninth Circuit Court of Appeals to rehear their case regarding Dicamba herbicide. The appeals court 3 judge panel in June vacated the registration for Dicamba. The groups want an en-banc hearing where all nine judges would hear the case. American Soybean Association Vice President Kevin Scott who farms near Valley Springs, South Dakota says they’re watching this case closely.

He says sound science and the use of dicamba over several years has proven its safety and he’s hopeful the court will lift that vacation and allow dicamba use to move forward.

Scott says producers are limited by what products they can cost effectively use to control weeds without dicamba being registered.

BASF and Corteva Agriscience want the post emergent use of Dicamba to be allowed. Should the en banc review fail the final legal option for the companies would be to appeal to the U.S. Supreme Court.
