Appeals Court Rules in Favor of EPA in Chesapeake Bay

An Appeals Court has ruled in favor of the Environmental Protection Agency’s pollutant limits in the Chesapeake Bay. The American Farm Bureau had argued the EPA exceeded its authority by including deadlines and pollutant allocations in its regulation plan. South Dakota Farm Bureau President Scott Vanderwal is disappointed by the ruling.

Vanderwal says Farm Bureau is studying the ruling and deciding what their next step should be including a possible appeal to the Supreme Court.

Vanderwal says if they choose to appeal, they have a solid case to present to the high court. Farm Bureau has 90 days to seek an appeal before the Supreme Court.
