The American Farm Bureau’s analysis of the Waters of the U.S. rule finds the final rule to be more disagreeable than the Environmental Protection Agency’s original proposal. Nebraska Farm Bureau’s National Affairs Coordinator, Jordan Dux says EPA officials have carefully worded the rule and are leaving out important information about what the rule will and will not regulate.
Dux says their review of the regulation is a detailed legal analysis. He says regular farming practices can be regulated as a result of the rule.
He says Farm Bureau will continue fighting the EPA and US Army Corps of Engineers over the rule. He says they’ll go the legislative route and to the courts, if need be.
Dux says another problem their analysis found is the EPA and the Corps have the power to determine what falls under the regulation via remote desktop applications without ever stepping foot on the land in question.
