This week the 8th Circuit Court of Appeals handed down a decision on Iowa’s 2012 Ag Fraud or Ag Gag law. It upheld part of that measure but denied the other. Iowa Pork Producers Association Attorney Eldon McAfee says it was a partial win for agriculture and a partial victory for activists.
He says the Appeals Court ruled the 2012 Iowa law was too broad when it criminalized those who obtained access to an agricultural production facility by false pretenses.
McAfee says overall the Appeals Decision was positive for agriculture in that it was a better ruling than other court rulings which decided against agriculture.
McAfee says he’s watching closely to see what happens with another lawsuit challenging Iowa’s Revamped Ag Fraud law passed this last legislative session.
