AFBF And NPPC File Court Brief To Strike Proposition 12 As Invalid

The American Farm Bureau and the National Pork Producers Council are seeking to terminate California’s Proposition 12. The groups have jointly filed an opening brief with U.S. Court of Appeals for the Ninth Circuit asking the court to strike that measure as invalid. South Dakota Farm Bureau President Scott VanderWal who serves as AFBF Vice President says that proposition is in violation of the U.S. Commerce Clause and unfairly targets other state’s animal housing methods.

He says most producers know better about what’s best for their animals than do those so far removed from farms and ranches who are voting on something they know nothing about.

VanderWal says California’s Proposition 12 creates undue costs for producers, impacts other states and sets a bad precedent.

Starting in 2022, Proposition 12 prohibits the sale of pork not produced according to California’s production standards.
