ACE Disappointed The EPA Is Not Applying Court SRE Decision Nationwide

The Environmental Protection Agency is not moving ahead with applying the 10th Circuit Court Ruling on small refinery waivers from the RFS nationwide. The American Coalition for Ethanol is disappointing the agency is sitting on its hands with applying the rule. ACE CEO Brian Jennings says the EPA is waiting until an Appeals Court makes their decision.

He says the EPA’s action just delays any enforcement of the Renewable Fuel Standard which in turn causes more economic harm to ethanol producers who are already under pressure.

Jennings says the EPA is paying more attention to the needs of refiners rather than following the RFS which is the law.

Jennings says there are currently 25 small refiner waiver requests in front of the EPA administrator awaiting his decision. He says only 7 or 8 of those at the most should be approved while the rest should be denied.
