ACE CEO Pleased EPA Denies Gap Small Refiner Waiver Petitions

Monday, the Environmental Protection Agency followed through with President Trump’s directive and denied the gap small refiner waiver requests from the renewable fuel standard. American Coalition for Ethanol CEO Brian Jennings while hailing the decision says denying those is what the law itself requires and what the tenth circuit court confirmed earlier.

He says despite EPA’s Monday ruling, the fight with the oil industry may not be over as they have an opportunity to appeal the decision.

Jennings says while it’s positive the gap waiver requests were denied there are still several more waivers that were already granted that have damaged the renewable fuels industry.

The gap waivers that were denied covered the years 2011 through 2018. Jennings says now EPA needs to follow the 10th Circuit Court Decision and deny most of the pending small refiner waivers for 2019 and 2020.
